1. Acceptance of these terms
These Terms of Service (the "Terms") govern your access to and use of the website at kybernao.ai and its subdomains (the "Site"), operated by Kybernao Corp, a Delaware corporation ("Kybernao", "we", "us"). By accessing or using the Site you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.
If you access the Site on behalf of a company, agency, or other organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization as well as to you personally.
These Terms cover the public website only. Access to and use of the Kybernao platform, hardware, and services is governed by a separate written agreement between Kybernao and the customer. Where that agreement conflicts with these Terms, the agreement controls.
2. Scope of the Site
The Site provides information about Kybernao's products and services, career opportunities, and service status. Content on the Site is for general information. It does not constitute an offer, a warranty, or a commitment to provide any product, feature, capability, or level of service, and it does not constitute security, legal, or compliance advice.
Descriptions of controls, frameworks, and authorization support describe how Kybernao produces evidence and mappings. Authorization and compliance decisions remain with the customer and its authorizing officials.
3. Acceptable use
You agree not to:
- Access the Site by any automated means beyond ordinary search-engine indexing, or in a manner that places unreasonable load on our infrastructure.
- Probe, scan, or test the vulnerability of the Site or any related system without written authorization. Authorized security research is welcome through the address in Section 16.
- Submit false, misleading, or unlawful content through any form on the Site.
- Use the Site to infringe the rights of others, or in violation of export control, sanctions, or other applicable law.
- Copy, mirror, frame, or display the Site or any part of it, including its layout, design, or forms, on another site or service without our written consent.
- Use the Kybernao name, marks, or product names in meta tags, hidden text, or advertising keywords without our written consent.
- Access non-public areas of the Site or the systems of our providers, or circumvent any security or rate-limiting measure.
- Forge headers or otherwise send altered, deceptive, or false source-identifying information through the Site.
- Decompile, disassemble, or reverse engineer software used to deliver the Site, except where applicable law expressly permits it.
- Impersonate any person or organization or misrepresent your affiliation.
- Collect personal information about other visitors from the Site.
- Remove or alter any proprietary notice on the Site.
- Encourage or enable anyone else to do any of the above.
4. Monitoring and enforcement
We are not obligated to monitor use of the Site, but we may do so to operate and secure it, to confirm compliance with these Terms, and to meet legal requirements. We may investigate suspected violations, suspend or block access at our discretion and without notice, and cooperate with law enforcement where we believe conduct may be unlawful.
5. Requests and communications
The Site does not offer user accounts. When you submit a demo request, contact form, job application, or status subscription, you represent that the information you provide is accurate and that you are authorized to provide it. We may contact you about your request using the details you supply. How we handle that information is described in our Privacy Policy.
6. Feedback
If you send us ideas, suggestions, or other feedback about the Site or our products, you agree that we may use it without restriction or compensation to you, and that it is not confidential. This does not affect any rights you hold in your own pre-existing intellectual property.
7. Intellectual property
The Site and its content, including text, graphics, illustrations, product interfaces, animations, logos, and the Kybernao name and mark, are owned by Kybernao or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages from the Site for your own internal, non-commercial evaluation. Any other use, including reproduction, modification, distribution, or creation of derivative works, requires our prior written permission. Third-party names and logos shown on the Site belong to their respective owners and are used to identify integrations and compatibility. Their appearance does not imply endorsement.
8. Third-party services
The Site is delivered through Cloudflare and may include links to third-party sites and services. We do not control those sites and are not responsible for their content, availability, or practices. Links are provided for convenience only, and you assume all risk arising from your use of any third-party resource.
9. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason including violation of these Terms. Sections 6 through 14 survive any termination.
10. Disclaimers
The Site is provided "as is" and "as available". To the fullest extent permitted by law, Kybernao disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete, current, or accurate.
Service status information on the Site is provided for convenience and does not form part of any service level commitment.
11. Limitation of liability
To the fullest extent permitted by law, Kybernao and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim arising from the Site will not exceed one hundred US dollars (USD 100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. These limitations are a fundamental element of the basis of the bargain between you and Kybernao.
12. Indemnification
You agree to indemnify and hold harmless Kybernao and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable legal and accounting fees, arising from your access to or use of the Site or your violation of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles that would apply the law of another jurisdiction. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in the State of Delaware, and you and Kybernao each consent to their personal jurisdiction and venue. Nothing in this section limits either party's right to seek injunctive relief to protect intellectual property.
14. General terms
Reservation of rights. Kybernao and its licensors own all right, title, and interest in the Site, including all associated intellectual property rights. Nothing in these Terms grants you any right in the Site except the limited permission to use it as described.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Kybernao about the Site and replace any prior understanding about it. They do not modify any separate written agreement between Kybernao and a customer.
Severability. If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions stay in full effect.
Assignment. You may not assign or transfer these Terms without our written consent. Kybernao may assign them without restriction. Subject to that, these Terms bind and benefit the parties and their successors and permitted assigns.
Notices. We may give notice by email to an address you have provided or by posting on the Site. Email notices are deemed received when sent.
No waiver. Our failure to enforce any provision is not a waiver of it. A waiver is effective only if in writing and signed by an authorized Kybernao representative.
No third-party beneficiaries. These Terms create no rights for anyone other than you and Kybernao.
Export. You agree to comply with all applicable export control and sanctions laws in connection with your use of the Site.
15. Changes to these Terms or the Site
We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they last changed, and material changes will be indicated on this page. Continued use of the Site after a change means you accept the updated Terms. We may also change, suspend, or discontinue any part of the Site at any time without notice.
